GAME OF SKILL TERMS AND CONDITIONS FOR THE MODERN FISHING / LIFESTYLE CHANNEL 'CATCH OF THE WEEK' COMPETITION


1. Information on how to enter and prizes form part of these conditions. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.

2. Entry is open to residents of Australia who fulfil entry requirements as dictated in clause 3. Employees and their immediate families of the Promoter and its agencies associated with this competition are not eligible to enter this competition.

3. To enter:

a. Consumers must take a photo of a fish they have recently caught

and

b. Send us your full name, address and daytime contact number along with a copy of your photo: Modern Fishing Competition, Locked Bag 5030, Alexandria NSW 2015

4. The competition commences at 00.01 (AEDST) on Wednesday 7th July 2010 and closes at 23.59 (AEST) Friday 31st December 2010 (“Entry Period”). Entries will be accepted until Wednesday 24th November 2010.

5. Multiple entries are accepted, however each entry must be unique and sent in as a separate correspondence. Entries will not be entered into subsequent judging.

6. This competition is a game of skill. Chance plays no part in determining the winners. All entries will be judged individually on their merits based on creativity and the best looking fish. The best entries as determined by the judges, will win a prize.

7. Weekly judging will take place every Wednesday at 2pm for entries received Monday till Sunday from the previous week. Entries will be judged at News Magazines 180 Bourke Road, Alexandria, NSW 2015. The last date entries will be judged is Friday 26th November 2010. Entries will be judged by a panel of judges from News Magazines.

8. There are 24 Modern Fishing Prize Packs to be won, each consisting of:

a. Daiwa Fishing Reel - $199.95
b. Daiwa Hat - $19.95
c. Daiwa Key ring - $4.95
d. Daiwa Sticker - $3.95
e. Daiwa Lanyard - $1.95
f. Daiwa Pen - $1.95
g. Modern Fishing Magazine’s latest issue - $7.95
h. Lure courtesy of modern fishing - $9.95

Total Value of each prize $240.65

9. There is a total of 24 prizes with a total prize value of $5,775.60

10. The 24 entries judged to be the best will win a prize.

11. Prizes are not transferable and are not redeemable for cash. The judges’ decision is final and binding - no correspondence will be entered into. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if forged, manipulated or tampered with in any way.

12. In the event that any prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize of equal or greater value.

13. The winners will be notified by phone and or mail from within 2 days of judging.

14. Entry details remain the property of the Promoter. The name and photograph of the winner may be used for promotional purposes by the Promoter, unless the winner otherwise notifies the Promoter at the time of accepting the prize.

15. The Promoter shall not be liable for any loss, damage or injury suffered or sustained (even if caused by negligence) as a result of entering this competition, accepting and/or using a prize, except for any liability which cannot be excluded by law.

16. The Promoter reserves the right to request verification of age, identity, residential address of winners and any other information relevant to entry into or participation in this promotion. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who is involved in any way in interfering or tampering with the conduct of this promotion.

17. Entrants confirm and promise that their entry is original and does not infringe the intellectual property rights of any third party.

18. In the event of a promoter other than News Magazines cancelling any event related to this prize, News Magazines cannot be held responsible.

19. The winner agrees to participate in any news media activities surrounding the promotion such as photographic shoots and interviews.

20. Once the prize has left the Promoters premises the Promoter is not responsible for late or damage sustained during the delivery of the prize.

21. News Magazines collects your information to include you in this competition and will disclose the information to others who help us run the competition. We may also use the information to assist us in improving our goods and services and to contact you in the future in regard to our other goods and services. We may share your information with other persons or entities that assist us in performing the above or with another company which provides prizes for the competition.
